Town of St Johnsville Planning Board - July 12, 2022

Present: Chairman Michael Mancini, Member Julie Erno, Member Sally Countryman, Member Carol Pearl

Public: Martha Mancini and Louise Robusto

Meeting called to order at 7:00 PM - Motion by Member Sally Countryman, 2'' by Member Carol Pearl

Roll call of Members

Meeting minutes from June 14th, 2022 not reviewed as they are in the possession of Secretary Anthony Smida.

Public Comment: None

Old business:

Solar Law Review - Chairman Mancini will submit the modification to the current Solar Law to the Town Board for approval upon a motion from the members to do so, Member Sally Countryman motioned to submit for approval 2nd motion by member Carol Pearl, all in favor.

New business:

Comprehensive Plan - Chairman Mancini discussed that the current comprehensive plan should be updated every 10 years. The town residents could also participate with ideas if the planning board could somehow reach out to the residents in various ways with a "questionnaire". The various ways could include:

Sent by mail (would be costly)

Placed at certain locations in the town and village

Put on Facebook

Chairman Mancini asked if a Facebook page should be set up for the planning board, Member Carol Pearl motioned yes with a 2nd motion by Member Sally Countryman, all in favor.

Public Comment: None

The next regular meeting will be August 9th, 2022 at 7pm.

Motion to adjourn by Member Carol Pearl, 2nd by Member Countryman, all in favor. Meeting adjourned at 8:10pm.

Town of St. Johnsville Planning Board - JUNE 14, 2022

Present: Chairperson Michael Mancini, Member Julie Erno,

Public: Martha Mancini, and Louise Robusto

Meeting Called to Order: Time 7:03PM by Chairman Michael Mancini

Salute to the Flag Roll Call of Members

Meeting Minutes: 10 MAY 22 meeting minutes were reviewed. Member Sally Countryman motioned to accept the minutes 2nd by Member Carol Pearl Motion Carried 5 Aye/0 Nay

Public Comment:

Louise Robusto asked if new business in town needs to come in front of Board - if the business is in accordance to land use laws, there is no reason for the business to come in from of the Planning Board,

Old Business:

Solar Law Review: Review of Changes of 2mW to 5mW in accordance with state changes and changes to decommissioning section.

New Business:

No New permit requests.

Chairman Michael Mancini suggested adding Historical Zone to the list of exceptions of permitted zones for Utility Scale Solar energy systems on Page 7 Section C. Motion to send suggested changes in Solar Law to the Town Board made by member Anthony Smida. Second by member Julie Erno. Motion Carried 5 Aye/0 Nay.

Chairman Michael Mancini suggested discussing with Town of Dolgeville their method of online questionnaire to the Town with regard to the Town Boards request for revision of the Comprehensive Plan. It was decided to discuss this next month.

Public Comment:

Martha Mancini discussed the Town had received a "Letter to Supervisors" in which towns in the area are being asked to meet to discuss approach to Solar Laws.

Town of St Johnsville N.Y. Planning Board Reg. Meeting - May 22, 2022

Public: Martha Mancini, Louise Robusto and Attorney Greg Dunn Meeting Called to Order: Time 7:02PM by Chairman Michael Mancini

Meeting Minutes: 12 APR 22 meeting minutes were reviewed. Member Julie Erno motioned to accept the minutes. 2nd by Member Carol Pearl . Motion Carried 5 Aye! 0 Nay

Public Comment: None

Old Business:

Suits Parcel - Part of which is in Town of Palatine and Part in Town of St. Johnsville - looking to subdivide. All Appropriate forms provided by Attorney Dunn. Public Meeting held 12 APR 22 at 6:45 PM. No dissenting public comment. Motion to grant subdivision made by member Anthony Smida. Second by member Carol Pearl. Motion Carried 5 Aye! 0 Nay.

New Business:

Withholding forms and employment documents were provided to Town Planning board members - New member Carol Pearl will return to Town Clerk.

Chairman Michael Mancini presented some proposed changes to Town Solar Law. Suggestions include revising all instances of 2MW to 5MW (state limit in NY PCL Section 66-J) to line u with state law and to revise Section 12 on page 8 to read:

Annual Documentation: Verification by the utility company that the utility-scale solar energy system is still active shall be provided annually to the Town of St. Johnsville Code Enforcement Officer. This report should also include a review of the current decommissioning costs and an estimate of the scrap value at that time. The decommissioning review will insure that the surety bond which was set and posted at the time of construction permit is sufficient. This bond is renewed annually. Reviewing annually will make sure that the Town of St. Johnsville will make sure that the funds will be available to properly decommission the solar energy system according to this law. Failure to file this annual report in a timely manner will result in the cancellation of Certificate of Occupancy. Member Anthony Smida stated he is not familiar enough with NY PCL Section 66-J to feel confident to revise town solar law tonight. Chairman Michael Mancini stated that was not the intent, but rather to bring suggestions for future revisions before moratorium ends. There was also discussion of state requirements of minimum acreage amounts for Utility Scale Solar and inclusion into Town solar law.

Chairman Michael Mancini also explained to the Town Planning Board that the Town Board has tasked us with possible revision to Town Comprehensive Plan. This would necessitate a questionnaire to the Town. Discussion ensued on possible methodology of the questionnaire.

The next regular meeting will be held 14 Jun 22 at 7:00PM
