TOWN BOARD MEETING - April 11, 2017

A regular meeting of the Town of St. Johnsville was held on April 11, 2017, at 7:00 p.m., at the Town Offices, 7431 STHWY 5, St. Johnsville, NY 13452

Minutes - Motion by Councilman Hezel, seconded by Councilman Smith to accept the minutes of the March 9° regular meeting and March 20th public hearing and special meeting; passed 5-0. (Res.#17-041)

Departmental Reports - Motion by Councilman Hezel, seconded by Councilman Smith to accept the Town Clerk, Justice, Dog Control Officer & Planning Board monthly reports; passed 5-0. (Res. #17-042)

New Business

1. Supervisor's Monthly Financial Report 3/2017— Motion by Councilman Hezel, seconded by Councilman Smith to accept; passed 5-0. (Res. #17-043)

2. Spring Clean-Up - Motion by Councilman Smith, seconded by Councilwoman Handy to hold a Spring Clean-up on May 5th & 6th  as a first choice or May 19th & 20th; passed 5-0. (Res. #17-044)

3. Code Enforcement/Dog Control Report - Supervisor Stagliano reported that he received a call from the Montgomery County SPCA on March 31" regarding Roger Johnson's property on Allen Heights Rd. stating that he has been removed from the house and they are overwhelmed with the 50 cats he has at the property and are asking the Town for monetary help. The situation was discussed and Supervisor Stagliano will ask that the Code Enforcement Officer go to the property and report back to him regarding the situation.

4. Dog Incident - James Castrucci reported to the Supervisor that a person was picked up on a warrant through the court and had a dog with him. It was asked that the Dog Control Officer hold the dog for a couple of hours and he said he would not be able to do that, nor would Jim Brownell acting as his backup.

5. Road Work — Supervisor Stagliano said we still need a road contract and our CHIPS money is being banked.

6. Garbage/Recycling - there has been numerous issues with the driver from County Waste texting while driving and being careless and leaving debris along roadways.

7. Truck Purchase - Councilman Millington is to meet with the Highway Department to review specifications for a new truck purchase.

8.  Planning Board discussion took place regarding the petition being circulated by Martha Mancini, Chairman of the Planning Board for the Town of St. Johnsville, attempting to dissolve the Village through a referendum. The Town Board feels that Martha is putting the town in a bad position, and does not want it portrayed that she is acting on behalf of the Town. Motion by Councilman Smith, seconded by Councilman Millington to authorize Supervisor Stagliano to send a letter to Martha Mancini expressing the Planning Board's authority, and that they are not representing the town in her quest to dissolve the Village. (Res. 417-045)

Audit —(#170551-170578) Motion by Councilman Hezel, seconded by Councilman Smith to authorize the Supervisor to pay vouchers; passed 5-0. (Res. #17-046)

TOWN BOARD PUBLIC HEARING/MEETING - March 20, 2017

A public hearing /meeting of the Town of St. Johnsville on a proposed Local Law No. I of 2017 "A Local Law To Increase The Salary Of The St. Johnsville Town Justice During His Term Of Office" was held on March 20, 2017, at 5:00 p.m., at the Town Offices, 7431 STH WY 5, St. Johnsville, NY 13452

Present: Dominick Stagliano, Supervisor; Ronald Hezel, Councilman; Susan Handy, Councilwoman; Timothy Smith, Councilman; Lynn Stever, Town Clerk;

Absent: Ronald Millington, Councilman

Public: Wayne Handy

Public hearing opened at 5:00 P.M. No one from the public spoke. Public hearing closed 5:05 p.m.

Motion by Councilman Hezel, seconded by Councilman Smith to adopt Local Law No. I of 2017; passed 4-0. (Res. #17-039)

Adjournment - Motion by Councilwoman Handy, seconded by Councilman Hezel; passed 4-0. (Res. #17-040) Meeting adjourned 5:06 p.m.

Roll Call - Councilman Millington absent Public Comment - none

Minutes - Motion by Councilman Hezel, seconded by Councilman Smith to accept the February 9, 2017 minutes; passed 3-1, Councilwoman Handy abstaining. (Res. #17-032)

Departmental Reports - Motion by Councilman Hezel, seconded by Councilman Smith to accept the Town Clerk, Justice, Code Enforcement Officer, Dog Control Officer, Supervisor & Planning Board monthly reports; passed 4-0. (Res. #17-033) Martha Mancini reported as Chairman of the Planning Board that they are continuing to work on solar projects, but feels problems with the Village is making their hands tied. She informed the board that the representatives from the solar companies want to meet with the Assessor regarding how they will be assessed. Martha said she suggested they wait until the Assessors receive training of assessing solar farms.

Correspondence - letter from the St. Johnsville Volunteer Fire Department inviting the Town Board to it Installation of Officer's Banquet on April 22, 2017.

New Business -

A. Annual Update Document - Supervisor Stagliano reported that the AUD has been filed and is available to the public for review.

B. Justice Court - Supervisor Stagliano stated that the Village will be dissolving their court, effective April 3, 2017. Motion by Councilman Hezel, seconded by Councilwoman Handy to adopt for presentation at a public hearing, Local Law No. 1 of 2017, "A Local Law To Increase The Salary Of The St. Johnsville Town Justice During His Term Of Office" from $5,982.00 to $12,000.00/annually and to set the public hearing/meeting for March 20, 2017 at 5:00 p.m.; passed 4-0. (Res. #17-034)

C. Budget Amendment - Motion by Supervisor Stagliano to amend the 2017 budget by increasing Al 110.1 from $5,982.00 to $12.000.00, and to create an account Al 110.110 (Court Clerk) at a salary of $3,000.00/yr., increasing A2610 (Fines) from $4,800.00 to $13,818.00, seconded by Councilwoman Handy; passed 4-0. (Res. #17-03 5)

D. Matis Drive - Supervisor Stagliano said a turnaround is needed for town plows, etc. to maintain this road. He suggested that Attorney Mastromoro draw up a written agreement between the landowner and the town granting an easement that will follow the property.

F. NYMIR Insurance Renewal - Motion by Councilman Hezel, seconded by Councilwoman Handy to accept the insurance renewal at a cost of $9,352.00; passed 4-0. (Res. #036)

Audit - Motion by Councilman Hezel, seconded by Councilman Smith to approve voucher # 170532-4170550 and authorize the Supervisor to pay; passed 4-0. (Res. #17­037)

Present:  Dominick Stagliano, Supervisor; Ronald Hezel, Councilman;  Timothy Smith, Councilman; Ronald Millington, Councilman; Lynn Stever, Town Clerk

Absent: Susan Handy, Councilwoman; Norman Mastromoro, Attorney for the Town

Public: James Saracino, Martha & Michael Mancini

Roll Call – Councilwoman Handy absent

Public Comment – James Saracino of 142 Matis  Drive addressed the board regarding issues on Matis Drive.  He said he was told that there is no money in the budget for roadwork, therefore, he has been ditching the roadway in front of his residence.  He claims that the town continues to fill in the ditches and is making the road higher for runoff to his property.  He presented pictures to the board.  He said the town had put down millings and did a nice job a few years ago, but the snow plow has plowed them all off.  He feels he is being harassed by the town’s snowplow driver and is bringing the issue to the attention of the Supervisor and Town Board.  Supervisor Stagliano said he will speak to the Maynard  Baker, Highway Superintendent regarding these issues.

Departmental Reports – Motion by Councilman Hezel, seconded by Councilman Smith to accept the Town Clerk, Justice, Code Enforcement Officer & Dog Control Officer’s monthly reports; passed 4-0. (Res. #17-027)  Martha Mancini, Chairman of the Planning Board reported that the Planning Board has reviewed the Comprehensive Plan and feels that for companies to be interested in coming to St. Johnsville we must offer water and sewer.  They feel a dissolution of the Village government needs to be done and water, sewer, street lighting and a police force should be town wide.  A lengthy discussion followed with Supervisor Stagliano offering to provide any documentation she needs in her effort to accomplish this.  He stated it has been discussed in the past and has been met with overwhelming objections.

  1. James A. Brennan Animal Shelter Contract – Motion by Councilman Millington, seconded by Councilman Smith to accept the annual contract at a cost of $2,400; passed 4-0. (Res. #17-028)
  2. Montgomery County Snow & Ice Contract – Motion by Councilman Hezel, seconded by Councilman Smith to accept the contract for 2017 at $5,650.00/miles X 13.25 miles, totaling $74,862.50; passed 4-0. (Res. #17-029)
