TOWN REGULAR BOARD MEETING - November 11, 2021

A regular meeting of the Town of St. Johnsville was held on November 11, 2021, at 7:00 p.m., at the Town Offices, 7431 STHWY 5, St. Johnsville, NY 13452

Minutes - Motion by Hezel, seconded by Mancini to accept the minutes of October 14, & November 04, 2021; passed 5-0. (Res. #21-066)

Departmental Reports - Motion by Hezel, seconded by Haines to accept the Justice, Code Enforcement Officer and Dog Control Officer's monthly reports; passed 5-0. (Res. #21­067) The Town Clerk does not have a paper copy of her report, but a check in the amount of $33.12 was issued to the Supervisor. Clerk will provide paper copies when new computer is up and running. The Assessor said she also needs a computer and would like a laptop.

New Business

A. Planning Board - Motion by Mancini, seconded by Hezel to authorize Attorney Mastromoro to research how the Planning Board was created and to work up a Local . Law amending it to include salaries of $75 for Chairman, and $50 for members per month along with appointing alternates; passed 5-0. (Res. #21-068)

B. Assessor - Leighanne Loucks, Sole Assessor addressed the board regarding an ongoing issue with her NYS Retirement. She said she has done calendars multiple times, errors were made when reporting was done, corrections were not made and she has been suspended numerous times. Supervisor Stagliano has put together information from the beginning and said she has never been suspended from the Town of St. Johnsville's errors in reporting. He said everything has been corrected and her reporting will be 5.14/7.70 for 26 biweekly pays and 4.95/7.42 for 27 biweekly pays. Leighanne asked that he monitor the reporting to see that it is done correctly.

C. Computer Purchase - Ron Hezel has been assigned the liaison for the Assessor and the Town Clerk's computer purchase.

D. Montgomery County Snow & Ice Contract - Motion by Hezel, seconded by Robusto to approve the 2022/2023 Contract; passed 5-0. (Res. #21-069)

TOWN BOARD PUBLIC HEARING - November 04, 2021

The Town of St. Johnsville held a Public Hearing on the 2022 Preliminary Budget on November 4, 2021, at 7:00 p.m. at the Town Offices, 7431 STH WY 5, St. Johnsville, NY 13452

Present - Dominick Stagliano, Supervisor; Martha Mancini, Councilwoman; Ronald Hezel, Councilman; Louise Robusto, Councilwoman; George Haines, Councilman & Lynn Stever, Town Clerk

Absent - none

Public -Michael Mancini

Public Hearing opened at 7:00 p.m. and notice read by the Clerk. Michael Mancini addressed the Supervisor asking if he received his budget request for the Planning Board. Supervisor Stagliano said he did and that the board will need to make any changes to the budget by resolution. Motion by Hezel, seconded by Haines to close the Public Hearing at 7:03 p.m.; passed 5-0. (Res. #21-063)

The special meeting opened at 7:03 p.m. for the adoption of the 2022 Budget.

Motion by Mancini, seconded by Robusto to increase B8020.1 to $5,000 with funding by additional appropriation from the Fund Balance in the amount of $5,000, and to adopt as the 2022 Adopted Budget; passed 5-0. (Res. #21-064)

Supervisor Stagliano stated that a Local Law will need to be created for Planning Board members to be paid and alternates appointed.

The Town of St. Johnsville held a regular monthly meeting on October 14, 2021, at 7:00 p.m. at the Town Offices, 7431 STHWY 5, St. Johnsville, NY 13452

Meeting called to order 7:00 p.m.

Public Comment -Todd Kerzic asked the board if they knew who was cutting the trees along Allen Heights Road. Supervisor Stagliano said it was not the town and thought maybe the solar company. Michael Mancini made a request to the board that they include $6,500 in the 2022 budget for the Planning Board.

A. Drinkwater Solar - Supervisor Stagliano and the Town Board had a discussion last month regarding questions they need clarified. Attorney Mastromoro contacted Cypress Creek and they had no response to date. It was agreed that the Town of St. Johnsville still needs to know the relationship between Cypress Creek and General Capital.

B. Other—none

New Business

A. 2022 Budget -Supervisor Stagliano reviewed the proposed tentative budget line byline with the Town Board. Motion to accept the 2022 Tentative Budget as the 2022 Preliminary Budget by Hezel, seconded by Haines; passed 5-0. (Res. #21-057) Motion by Hezel, seconded by Haines to set the public hearing on the 2022 Preliminary Budget for November 4, 2021, at 7:00 p.m.; passed 5-0. (Res. #21-058)

B. NYS Retirement - Motion to amend Town Justice, Bruce R. Dye to 5.28 days per month due to increased workload from when the Village Court dissolved; passed 5-0. (Res. #21-059)

C. Health Insurance Renewal - Motion by Robusto, seconded by Mancini to continue with Simply Blue Plus Gold 19 Plan as proposed; passed 5-0. (Res. #21-060)

B. Fall Clean-Up - Motion by Haines, seconded by Hezel to hold a Fall Clean-Up on October 15th & 16th from 7-2 p.m.; passed 5-0. (Res. #21-052)

C. 2022 Budget - Supervisor Stagliano will send out budget requests to all department heads to be returned by the 20th.

D. Drinkwater Solar - discussion took place regarding the owner of the Drinkwater Solar Project. Questions that arose are whether they will continue to abide by the contract and payment to the Town. Originally the project was touted that the Town of St. Johnsville residents would be able to hook up and receive cheaper power, however, that does not seem to be an advantage any longer.

Councilwoman Mancini stated that we must make sure the residents of St. Johnsville will be protected, and that the new company will abide by the original contract. Items that need to be clarified are the corporate make-up, accepting financial agreements and bonds.

E. Board of Assessment Review - it was discussed that at the 2021 Grievance Day, board members Joseph-Sokol and Terry Swartz did not attend. Three members were in attendance, therefore, a quorum did exist.

Correspondence - Animal Shelter Report &'NYS Division of Budget letter granting $86,110, with half now and half in twelve months to the Town of St. Johnsville

A. Drinkwater Solar - discussion took place regarding the recent sale of Cypress Creek. It was agreed that questions need to be answered regarding the status of both solar projects and ownership.

B. Edwards Road - The board agreed that the distance of Edwards Road is 305'; the Highway Superintendent will back in to plow and maintain a distance of 305' which will not require a turnaround.

C. Kennedy Road Paving - Motion by Haines, seconded by Hezel to accept the bid received from Hanson Aggregates in the amount of $153,743.75; passed 5-0. (Res. #21-044)

D. Planning Board - Michael Mancini, Chairman of the Planning Board addressed the Town Board regarding Planning Board member Lacey Augustine. He has made numerous attempts to contact her through phone, text, emails, etc. with no return response. He stated that the Planning Board needs to have a working board and informed the board that he has been in contact with Melanie Shuster who offered to fill in as an alternate. Motion by Stagliano, seconded by Mancini to hold a public hearing on September 9, 2021, at 6:55 p.m. for the purpose of removing a member of the Planning Board; passed 5-0. (Res. #21-045) Attorney Mastromoro directed the Town Clerk to send a letter to Lacey Augustine both regular mail and certified return receipt asking if she still wishes to remain a Planning Board member.

(Res. #21-033) Motion by Hezel, seconded by Haines that the Code Enforcement Officer's statement on his report regarding inaction by the Courts, he will not be citing any codes violations at a specific property is not acceptable; he must continue to cite all violations regardless of actions by the Court; passed 4-0. (Res. #21-034)

Correspondence - A letter of resignation from Mariah Decker from the Planning Board, along with two anonymous letters from "concerned citizens" regarding a new mining operation in the Town of St. Johnsville. (The new mining operation is not located in the Town of St. Johnsville, it is located in the Town of Oppenheim).

New Business

A.     CEO Report - the board agreed by the Code Enforcement Officer must continue to cite property maintenance violations, whether or not the Courts take action. Motion by Robusto, seconded by Hezel directing the Town Clerk to draft a letter to the Code Enforcement Officer stating such and send Certified Mail-Return Receipt Requested and regular mail; passed 4-0. (Res. #21-035)

B.    Planning Board Vacancy - Due to the resignation of Mariah Decker, Michael Mancini will act as Chairman of the Planning Board until January 2022. Motion by Hezel, seconded by Robusto to set a special meeting for the purpose of interviewing Andrew Gandy who has applied for a position on the Town of St. Johnsville Planning Board for July 22, 2021, at 6:30 p.m.; passed 4-0. (Res. #21­036)

C. 2021 Highway Agreement - Motion by Hezel, seconded by Robusto to approve

the 2021 Highway Agreement as presented by William Putman, Highway Superintendent with the paving of Kennedy Road. It was also agreed to advertise for Kennedy Road paving bids to be opened on August 12, 2021, at 6:45 p.m.; passed 4-0. (Res. #21-037)

Public Comment - Clyde Snyder addressed the board regarding Edwards Road. His barn recently burned and would like a definitive answer as to where the legal end of the right-of-way is to determine where he can build a hay storage building. Norman Mastromoro, Attorney for the Town will research and it will be put on the August agenda. William Putman, Highway Superintendent provided an aerial map showing the end of Edwards Road, along with the area that the Town plow trucks turn around. Motion by Robusto, seconded by Haines to table; passed 4-0. (Res. #21-039)

Public Comment - Michael Mancini spoke regarding the house across the road from the town building. He questioned whether the new owner was living there and if it was known if they have water hooked up, etc.

Departmental Reports - Motion by Hezel, seconded by Robusto to accept the Town Clerk, Code Enforcement Officer, Dog Control Officer and Justice monthly reports; passed 5-0. (Res. #21-028)

Correspondence - A resolution from the Village of St. Johnsville stating that they will take over dog licensing for residents within the Village limits as of June 1, 2021. A letter from Andrew Grandy stating his interest in serving on the Town of St. Johnsville Planning Board. An invitation from the "Friends of St. Johnsville" to attend the tree planting at the Soldiers & Sailors Memorial Park.

Old Business:

A. Drinkwater Solar - James Castrucci stated that he has been contacted by Drinkwater Solar regarding changing the permit to their name instead of Roger Lottman's. James told them no it must be in the landowners name; he has not heard anything from them in three weeks.

New Business:

A. Village Dog Licenses - Beginning June 1, 2021, the Village will be taking over the licensing of dogs within the Village limits, and enforcing NYS Agriculture & Markets Law. They will appoint their own Dog Control Officer as well as obtain a shelter. Any fines and fees should be collected by the Village.

B. James A. Brennan Animal Shelter Contract - Motion by Hezel, seconded by Mancini to accept the annual contract in the amount of $2,400; passed 5-0. (Res. #21-029)

Public Comment - Michael Mancini from the Town of St. Johnsville Planning Board reported that the Planning Board will not hold a meeting in June because Mr. Brower has withdrawn his subdivision application, and that was the only item on the agenda.

Audit - Motion by Hezel, seconded by Haines to accept the audit of vouchers #21-025 through 21-051 in the amount of $62,544.62 and authorize the Supervisor to pay; passed 5-0. (Res. #21-030)

A. Stimulus Money - Supervisor Stagliano reported to the board the Town should be receiving stimulus money, but has not been given a figure to date.

B. Copier & Supervisor's Computer - Supervisor Stagliano reported that the Supervisor's computer has crashed and on a recommendation from the Steve Trodler, Village IT, it was suggested that a new system be purchased. We will be doing away with the Business Automation Services for the Supervisor's books and returning to QuickBooks. The copier still needs to be looked at because we are not able to scan to our computers.

C. Sourcewell - Attorney Mastromoro reported that he has researched them and they are a governmental entity out of Minnesota and is recognized by New York State. By joining Sourcewell, it allows municipalities to buy under state bid in a nationwide cooperative.

A. Montgomery County Brush & Weeds - Motion by Hezel, seconded by Robusto to accept the contract for 2021/2022 in the amount of $5,300, and authorize the Supervisor to sign; passed 5-0. (Res. 921-017)

C. Grievance Day Resolution - the sample resolution authorizing electronic filing of grievances was reviewed by the board. It was agreed not to allow electronic filing because we usually only receive one or two grievances.

D. Spring Clean-Up - William Putman, Hwy. Superintendent would like to hold it the same time as the Village. It was agreed to have the Clerk contact the Village to find out their dates and it will be addressed at the special meeting on the 15.

Minutes - Motion to accept the minutes of February 11, 2021 by Hezel, seconded by Haines; passed 5-0. (Res. #21-009)

Departmental Reports - Motion by Hezel, seconded by Haines to accept the Town Clerk, Code Enforcement Officer, Justice, Dog Control Officer and Supervisor's monthly reports; passed 5-0. (Res. #21-010)

Correspondence - letter received from the Chamber of Commerce updating information. Old Business - none

New Business

A. Truck Purchase - William Putman, Hwy. Superintendent reported that the town will receive $49,500 from NYMIR for the total loss of the 2008 Ford dump truck. William presented a cost of $45,500 for a cab and chassis for a 2021 Ram 5500, with wing and sander at a cost of $39,978.10 with building the truck in house. Motion to purchase the 2021 Ram 5500 with state bid specs by Haines, seconded by Hezel ; passed 5-0. (Res. #21-011) Motion by Hezel, seconded by Mancini to enter into a cooperative purchasing agreement with Sourcewell and authorize subject to specs and Sourcewell for plow, wing and sander assembly from Viking; passed 5-0. (Res. #21-012) Supervisor Stagliano stated that at some point the tractor, mower and sweeper should be the next to be replaced.

B. Annual Report - Supervisor Stagliano will provide copies to all members. Fund Balance totals are General $103,000/Part-Town $85,000/Highway $240,000.

C. Stimulus Package - Supervisor Stagliano stated that the town will be receiving a stimulus package and suggested improvements be made to the town barn.

D. Planning Board - Vacancies exist on the Planning Board. It was agreed to have Louise Robusto mention the vacancies on Facebook and ask that any interested individuals contact the Town Clerk. Once a full board is in place it was agreed that they need to update the Comprehensive Plan and plan for the future through Economic Development.

E. Friends of St. Johnsville Grant - this group is looking for money from the Town to match a proposed grant for trees at the Soldiers & Sailors Park.

F. Other - none

B.    Friends of St. Johnsville Resolution - a request for a supporting resolution from the Village has been received. The Friends of St. Johnsville are seeking funds through a grant for the Soldiers & Sailors Park. Motion to approve by Haines, seconded by Hezel; passed 4-0. (Res. #21-004)

C.  2021 Wage & Fee Schedule - Motion by Hezel, seconded by Haines (See Attached) to approve; passed 4-0. (Res. #21-005

D.    Board of Appeals - Motion by Hezel, seconded by Haines to reappoint Robert Smith to the Board of Appeals, expiration 12/2023; passed 4-0. (Res. #21-006)

Public Comment - William Putman questioned the board whether the Town can purchase a new truck since the 2008 Ford is totaled due to a fire. Supervisor Stagliano said yes and that he should get prices an bring to the board in March.
