Board of Trustees Regular Meeting - May 18, 2021  - 6:30 PM Community House

Present: Mayor Straney, Village Clerk Jayna Cool, Trustees: Kathy Buckley, Art Dockerty, Jim Castrucci and Connie Grant.

The meeting was called to order at 6:30 pm by Mayor Straney and the salute to the flag was given.

Department Heads:

Fire Department: Chief Countryman stated Engine #3 is out of commission.  Engine 6’s tank fill lights are not functioning, and the age of the vehicle makes it more difficult to find parts.  Every vehicle passed the pump test.  Report submitted.

DPW: DPW Superintendent Jarrod Walrath discussed the marina wall, water, boat launch, and dock.  There was 16 days of rain in a 19-day span.  Report submitted.  

WWTP: No one present.  Mayor Straney stated that he is waiting to get a quote for the RAS pumps.  We need 3 and there are currently 1.5 working.  Report submitted. 

Police: Chief VanDeusen stated the tuition of Phase 2 Police Academy had doubled to $1,000.00.  There is also an ammunition shortage for the Police Department.  Report submitted.   

Codes: No on present, Report submitted.  Mayor Straney discussed the citations on Hough Street.  

Marina:  No one present, no report.  Mayor Straney discussed some new information he learned about the rows at the campsite.  The front row is meant for motor homes.  The middle and back row are meant for Fifth-Wheels. 

Treasurer: Reports submitted.

Dog Census:  A motion was made by Trustee Dockerty and seconded by Trustee Castrucci to approve Resolution #8 of 2021 pertaining to dog licensing.  All ayes, motion carried.

Cemetery-No one present, no report.  A motion was made by Trustee Grant and seconded by Trustee Castrucci to approve the new Cemetery pricing schedule, effective June 1st, 2021.  All ayes, motion carried. 

Public:  No public comments.

Legals: Soccer Field Contract is still on the table.

Board meeting with be discussed with Attorney Mastromoro and NYCOM. 

The propane quote from Harbor Point will be compared with Mirabito.

Trustee Dockerty will be handling the Park music for this summer.

Consent Agenda: A motion to create a consent agenda consisting of the minutes of the 4/20/21 Regular Meeting, DPW, WWTP, Police, Codes and Treasurer’s reports was made by Trustee Grant and seconded by Trustee Dockerty.  All ayes, motion carried.

A motion to adopt said Agenda was made by Trustee Buckley and seconded by Trustee Castrucci.  All ayes, motion carried.

Audit of Claims: A motion to accept the claims as presented to the Board as approved to the Board by the Treasurer, in the amount of $109,039.43 was made by Trustee Grant and seconded by Trustee Dockerty.  All ayes, motion carried.  The claims are broken down as follows:

General Fund: $64,674.84

Cemetery Fund: $465.47

Marina Fund: $8,070.88

Water Fund: $3,953.54

Sewer Fund: $31,874.70

Other:

A motion to go into executive session to discuss personnel was made at 8:30 PM by Trustee Dockery and seconded by Trustee Buckley.  All ayes, motion carried.

A motion to come out of executive session and back into the regular meeting at 8:45 PM was made by Trustee Grant and seconded by Trustee Buckley.  All ayes motion carried.

A motion was made by Trustee Grant and seconded by Trustee Dockerty to increase Frank Erno’s pay to $50,000.00 per year.  All ayes, motion carried.

A motion was made to adjourn the regular meeting at 8:55 PM by Trustee Grant and seconded by Trustee Dockerty.  All ayes, motion carried.

The meeting was called to order at 6:30 pm by Mayor Straney and the salute to the flag was given.

Discussion pertaining to the Village Tax Cap, Fire Department, Marina, and the Waterway ensued.

A motion was made by Trustee Grant and seconded by Trustee Dockerty to close the public hearing at 6:35 PM. All ayes, motion carried.

4/20/21 Board of Trustees Regular Meeting 6:30 PM Community House

The meeting was called to order at 6:30 pm by Mayor Straney and the salute to the flag was given.

Department Heads:

Fire Department: Chief Countryman discussed the issues with Engine #3 found during the pump testing. The ladder testing will be done in May. The pump testing was done today on Engine 1,3, and 6. The Fire Department has resumed in person training. Chief Countryman also shared with the Board that they have had a great turn out for calls and the response time went from 12 minutes a few months ago, to under 2 minutes currently. Report submitted.

DPW: DPW Superintendent Jarrod Walrath stated that they will be using the street sweeper during the next few rainy days. The sweeper handles the wet roads better and it also causes less dust. The sweeper has been around the Village twice prior. Jarrod also stated that they have had 2 burials at the cemetery, and they have 9 more to do before May 15th Report submitted.

WWTP: No one present. Report submitted.

Police: Report submitted. Chief VanDeusen stated that the burn ban is in effect until May 15th Codes: Report submitted. Cliff informed the Board of the citations and clean ups that are occurring within the Village. He has taken two NYSBOC classes and has one more coming up.

Marina: No one present, no report. Fuel pumps are working after having been repaired by Village staff. An outside contractor will install and calibrate the pumps in preparation for the Marina Season.

Treasurer: Reports submitted.

Public: Jeremy Polidori had questions pertaining to terraces, water shut offs, and sewer mains.

Dog Census: Mayor Straney discussed the income from new dog registries with Village Attorney Norman Mastromoro.

The Public Health Emergency Plan is currently in draft form.

New Business:

A motion was made by Trustee Buckley and seconded by Trustee Grant to adopt Local Law number 2 of 2021 for enactment to exceed Village Tax Cap with Village Clerk to complete all filing requirements with the Secretary of State. All ayes, motion carried.

A motion was made by Trustee Buckley and seconded by Trustee Grant to adopt the Budget for the 2021-2022 Fiscal Year. All ayes, motion carried.

A motion was made by Trustee Castrucci and seconded by Trustee Buckley to $0.00 the Combined Utility bill for 6 Ann Street due to request to have water shut off on 9/9/2020 and not being able to shut it off until 10/27/20. All ayes, motion carried.

A motion was made by Trustee Grant and seconded by Trustee Castrucci to deny the request from 56 N. Division to $0.00 their bill due to the water being on and having 60 cubic foot of usage. All ayes, motion carried.

A motion was made by Trustee Castrucci and seconded by Trustee Buckley to $0.00 the Combined Utility bill for 57 N. Division Street due to the owner having requested the water to be shut off on May 1, 2020 and having only 1 cubic foot of usage. All ayes, motion carried.

Consent Agenda: A motion to create a consent agenda consisting of the minutes of the 3/16/21 Regular Meeting, DPW, WWTP, Police, Codes and Treasurer's reports was made by Trustee Grant and seconded by Trustee Castrucci. All ayes, motion carried.

A motion to adopt said Agenda was made by Trustee Castrucci and seconded by Trustee Dockerty. All ayes, motion carried.

Audit of Claims: A motion to accept the claims as presented to the Board as approved to the Board by the Treasurer, in the amount of $57,223.72 was made by Trustee Grant and seconded by Trustee Buckley. All ayes, motion carried. The claims are broken down as follows:

General Fund: $44,771.37

Cemetery Fund: $275.86

Marina Fund: $121.96

Water Fund: $4,140.21

Sewer Fund: $7,914.32

A motion to go into executive session to discuss personnel was made at 7:55 PM by Trustee Grant and seconded by Trustee Buckley. All ayes, motion carried.

A motion to come out of executive session and back into the regular meeting at 8:30 PM was made by Trustee Grant and seconded by Trustee Dockerty. All ayes motion carried.

The meeting was called to order at 6:30 pm by Mayor Straney and the salute to the flag was given.

Department Heads:

Fire Department: No one present, no report submitted. Letters of support from US Congressman Delgado, US Senator Schumer, NYS Assemblyman Santabarbara, NYS Assemblyman Smullen, NYS Senator Hinchey and NYS Senator Oberacker have been submitted in support of the Village's request for Grant funds from FEMA for the purchase of a replacement Tanker for the Fire Department.

DPW: DPW Superintendent Jarrod Walrath stated the mowers have all been serviced and are ready to go for the 2021 Cemetery Maintenance season. Report submitted.

WWTP: No one present. No report. The CDBG Grant Request has been submitted. Police: Report submitted.

Codes: No one present. Report submitted.

Dog Census: Kirk Bayes has resigned the position of Census person for dogs within the Village. The Village Police will begin the Census & Enumeration process on weekends beginning in April. Cemetery-No one present, no report.

Public: Katrina Caringi asked the Board about a Village clean up day similar to the one completed in 2019. She also shared that there will be a small music festival at 44 Bridge Street on August 14th

Legals: Flood Plain Law was submitted and received by the State.

Old Business:

The Public Health Emergency Plan is due by April 1, 2021. It is currently in draft form.

New Business: Spectrum contract for phones was signed. The Friends of St. Johnsville received a $1,000.00 grant from the Urban Forestry Council for improvements at Soldiers & Sailors Park. The Chamber of Commerce will not be having Springiest this year. The American Legion has begun the preparation for the Memorial Day Parade. The LWRP Grant which was used for the improvement of the Soldiers and Sailors Park wall was discussed. The Department of State has placed a contingent liability on the Village in the amount of $14,900 for failure to meet MWBE goals associated with this project. Future Grants offered to the Village will require an increase in the MWBE goal to address this shortfall. The Village Clerk will be contacting Weaver's Sanitation to set up Trash Days in June.

Audit of Claims: A motion to accept the claims as presented to the Board as approved to the Board by the Treasurer, in the amount of $63,927.66 was made by Trustee Dockerty and seconded by Trustee Buckley. All ayes, motion carried. The claims are broken down as follows:

General Fund: $54,104.41

Cemetery Fund: $0.00

Marina Fund: $271.50

 Water Fund: $4,236.22

Sewer Fund: $5,315.53

A motion was made by Trustee Dockerty and seconded by Trustee Grant to approve the Police Reform Plan as prepared and presented, the Draft of which is currently posted on the Village Website. All ayes, motion carried.

A motion to go into executive session to discuss negotiation relative to water charges at the OESJ School was made at 7:45 PM by Trustee Grant and seconded by Trustee Dockerty. All ayes, motion carried.

A motion to come out of executive session and back into the regular meeting at 8:43 PM was made by Trustee Grant and seconded by Trustee Buckley. All ayes motion carried.

Fire Department: 1st. Assistant Fire Chief Shannon Countryman presented the Board with costs of ladder and pump testing. Discussion ensued. She also informed the Board that the FEMA grant was submitted. Report submitted.

DPW: DPW Superintendent Jarrod Walrath discussed the process of getting his Water License. He also informed the Board that he will be over budget on the Salt Budget Line due to the amount of snow the Village has steadily received. Police Chief Donald VanDeusen and Jarrod would like to sit with the Board after this Winter and discuss the administration of the Village owned Parking lot next to Kinney Drugs. Report submitted.

WWTP: No one present. No report. Mayor Straney discussed the quotes for new RAS pump at the WWTP. The pumps are original to the building of the plant in 1973.

Police: Chief VanDeusen discussed the Police Reform Public Meeting on February 17th. at 6:30PM via Gotomeeting.

Marina: No one present, no report. DPW Superintendent Jarrod Walrath will be pulling the gas pumps to see if they can be repaired.

Legals: Attorney Norman Mastromoro discussed Police disciplinary rules and confirming they are consistent. Follow-up on information relative to the Village not required to accept cash payments pursuant to an opinion request by Trustee Castrucci. The Flood Plain Law was received by the Secretary of State which was necessitated by a labeling error by the NYDEC..

The Public Health Emergency Plan is due by 4/1/21.

CBDG Public Hearing- A motion was made by Trustee Buckley and seconded by Trustee Castrucci to accept Resolution #3 of 2021 pertaining to the Intent to Apply for Community Development Block Grant in the amount of $50,000.00 for planning relative to the WWTP. All ayes, motion carried.

Consent Agenda: A motion to create a consent agenda consisting of the minutes of the 12/23/20 Regular Meeting, DPW, WWTP, Police, Codes and Treasurer's reports was made by Trustee Grant and seconded by Trustee Dockerty. All ayes, motion carried.

A motion to adopt said Agenda was made by Trustee Castrucci and seconded by Trustee Dockerty. All ayes, motion carried.

Audit of Claims: A motion to accept the claims as presented to the Board as approved to the Board by the Treasurer, in the amount of $173.594.96 was made by Trustee Grant and seconded by Trustee Dockerty. All ayes, motion carried. The claims are broken down as follows:

Fire Department: Mayor Straney discussed with the Board the vibration in Engine 1 potentially has been located and is not significant to the operation of the equipment. Shannon stated that the Fire Department needs to do ladder and hose testing. Discussion ensued. Report submitted.

DPW: There were 10 full burials and 10 cremations done at the Cemetery for the year. Jarrod presented some quotes to the Board regarding the budgeting for the purchase of a new backhoe. Report submitted.

WWTP: No one present. Report submitted.

Police: Chief VanDeusen discussed the Police Reform with the Board. The agreed to have a Public Meeting on February 17th at 6:30 PM via Gotomeeting. Clerk will prepare the necessary postings.

Codes: No one present. Report submitted.

Marina: No one present, no report. The Harbor Master House interior has been painted.

The Board needs to give thought to how we will proceed in the 2021 camping / boating season. Treasurer: The audit for the Fiscal Year ending 2019/2020 is almost complete. A motion was made by Trustee Dockerty and seconded by Trustee Grant to allow a transfer from the Water/Sewer account to the General fund in the amount of $14,371.00. This "Due To/Due From" was carried forward from previous fiscal years and will be reported in the 2019/2020 Audit. All ayes, motion carried. Reports submitted.

Legals: Attorney Norman Mastromoro discussed the ongoing issue with Town of Oppenheim and Ephratah taxes on the Village Watershed and the Election scheduled for March 16, 2021.

Resolution Friends of St. Johnsville- A motion was made by Trustee Castrucci and seconded by Trustee Dockerty to approve Resolution #1 of 2021 in support of pursuit by the Friends of St Johnsville of a Urban Forestry Grant. All ayes, motion carried.

Resolution Election - A motion was made by Trustee Grant and seconded by Trustee Dockery to approve Resolution #4 of 2021 regarding the March 16, 2021 election. All ayes, motion carried. FMLA- Concluded this legislation does apply to the Village operations and will be implemented. Spectrum- Board decided to go ahead with the transfer of phone lines from Frontier to

Spectrum at a saving to the Village.

CBDG Public Hearing- A motion was made by Trustee Buckley and seconded by Trustee Grant to hold a public hearing on February 16th at 6:15 PM regarding a Community Block Development Grant in the amount of $50,000.00 for planning relative to the WWTP. All ayes, motion carried.
